By accessing or using the Website, or by submitting any form on it, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Website.
2. Who we are and what we do
ForgePlan prepares business plans, financial analyses and source of funds documentation for clients seeking U.S. business and investment visas. Our team includes Mexican attorneys, accountants and financial analysts.
ForgePlan is not a law firm and does not provide legal advice on United States immigration law. Our attorneys practice Mexican law. Immigration strategy and the preparation and filing of any petition or application remain the exclusive responsibility of the client’s licensed U.S. immigration attorney.
3. No legal advice; no attorney-client relationship
The content of the Website, including articles, guides, frequently asked questions and the responses of our website assistant, is provided for general informational purposes only. It is not a substitute for the advice of an attorney. Using the Website, submitting a form or communicating with us through the Website does not create an attorney-client relationship of any kind.
4. No guarantee of results
Visa and immigration decisions are made solely by U.S. government authorities. ForgePlan does not guarantee the approval of any visa, petition or application, or any particular processing time or outcome. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS, OR THAT ITS CONTENT IS COMPLETE OR CURRENT, AS IMMIGRATION RULES, FEES AND PROCEDURES CHANGE FREQUENTLY.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FORGEPLAN AND ITS MEMBERS, MANAGERS, EMPLOYEES AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE WEBSITE OR ITS CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE WEBSITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). This section does not limit liability under your engagement agreement, which is governed by its own terms.

You agree to indemnify, defend and hold harmless ForgePlan and its members, managers, employees and affiliates from any claims, losses, damages and expenses, including reasonable attorneys’ fees, arising from your breach of these Terms or your misuse of the Website.
13. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising from or related to these Terms or the Website shall be brought exclusively in the state or federal courts located in Montgomery County, Texas, and you consent to the personal jurisdiction of those courts.
Nothing in these Terms limits any rights you may have under the mandatory consumer protection laws of your country of residence that cannot be waived by agreement.
14. General provisions
- Changes. We may update these Terms at any time by posting the revised version on the Website with its effective date. Your continued use of the Website after that date constitutes acceptance of the changes.
- Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and ForgePlan regarding the Website.
- Language. These Terms are provided in English with a Spanish translation for convenience. In the event of any conflict, the English version controls.
